âJesus! They sandbagged you!â Harry was struggling not to shout on the phone. âWhy didnât you ask for time to obtain instructions?â
âFrom a cretin, Harry? Go down to the cells to ask him? Wouldnât my judgment be preferable to his?â
âEveryone knows it isnât your client who decides these issues, Bella: you had to talk to Dave and me before you fell into that trap. And I certainly would have said no.â
âWhy? Be fair, Harry. A jury would have hated this fellow the minute they laid eyes on him. One look at him in the dock would be enough to terrify them, and thatâs without hearing about him telling lies to the police, beating the victimâs head in with the iron bar, or seeing the photographs of the body. Plus we have the benefit that Thatcher will have to write a very careful judgment about provocation, which, if it doesnât work for us, you can run an appeal on.â
âWhat an attractive strategy â waste my time arguing an appeal in front of a court where everyone knows one of themâs already written the judgment, and the other two see their job as ridiculing anything they donât like the sound of, whether they understand it or not.â
âAnd why was it a trap that I fell into, Harry? Why couldnât judge-alone favour the defence?â
âBecause if the bloody Crown want it, you donât. Theyâre scared of a sympathetic jury. By definition, itâs a trap. And the whole strategy of identifying the enemy simply wonât work without a jury.â
âQ.E.D.?â
âPrecisely.â
Neither said anything for quite a long time. Harry was sitting outside the Burragate house on the verandah, with the sun descending quickly behind the mountains to his left, no warmth left in it at all. He watched a small group of black wallabies grazing on the other side of the river, raising their heads to check for danger, hopping slowly to a new patch of grass and grazing again. The biggest of them turned its head to watch a rusa deer come out of the tree line. From somewhere deep in the national park a large-calibre rifle crashed a single echoing shot, and the animals fled back into the trees.
âThat bastardâs shooting again. I got the National Parks out here, but they stood around with their ponytails â they were blokes, I mean â and solemnly told me that theyâve spoken to him, and he said heâs only shooting vermin.â
âWhich they accepted without further enquiry?â
âAs you say. Bloody useless.â
âWell, whatâm I going to do, Harry? Shall I have David put it back in for mention and tell the judge that my instructions have changed, and Tony wonât consent â that he wants a jury?â
âNo.â
âNo, I suppose not. My fault.â
âAll you can do is run a bloody good trial, Bella. If you havenât got a jury that you can make fall in love with you, youâll have to settle for his Honour. Shouldnât be all that hard. Billy the Pig used to fancy himself as a bit of a pants man.
